Terms of Service
These terms are an agreement between you and Ditch.la LLC, which operates Lineup. By creating an account or using Lineup you agree to them. If you don't agree, don't use Lineup.
Brand program terms come from each brand
Lineup is a platform. Each brand that runs campaigns on Lineup sets its own creator program terms: what it pays, what it needs from your videos, how it may use them and how long they must stay posted. You see and accept those terms in the app before working with that brand. If a brand's program terms conflict with these terms about your work for that brand, the brand's terms apply to that work.
1. Your account
- You must be at least 18 years old and able to enter a binding contract to use Lineup.
- Give accurate information and keep it up to date, especially your contact details, shipping address and payout details.
- Keep your password secret. You're responsible for activity in your account. Tell us right away at support@lineupugc.com if you think someone else has used it.
- One person per creator account. Brand team accounts are for the people a brand authorizes, with the access that brand grants.
2. Your content
- You keep ownership of the videos, photos and other content you upload (“your content”), subject to the rights you grant a brand under its program terms.
- License to brands. When you submit content to a brand's campaign, you grant that brand the rights to use it that are set out in that brand's creator program terms, which you accept in the app.
- License to Lineup. You grant Ditch.la LLC a non-exclusive, worldwide, royalty-free license to host, store, copy, process and display your content only as needed to run Lineup, for example to deliver your submission to the brand, show it in the app and keep backups. This license ends when your content is deleted from Lineup, except for copies a brand has already received under its program terms and copies kept as described in our Privacy Policy.
- You confirm you have the rights to everything in your content, including music, people who appear in it and any brand marks other than the campaign brand's, and that it follows the law and the rules of TikTok, Instagram and any platform where you post it, including disclosing paid partnerships where required.
3. Earnings and payouts
- What you earn, and when, is set by each brand's program terms. Earnings show in the app once a brand approves your work and any required live period is met.
- When in-app payouts are on for your brand, they're made through Stripe Connect. To get paid that way you need a Stripe account in good standing, and you agree to the Stripe Connected Account Agreement. Stripe may ask you to verify your identity and tax details.
- You are responsible for your own taxes. We or Stripe may need to collect tax information and issue tax forms as the law requires.
- We may hold or reverse earnings that came from fraud, a breach of these terms or a brand's program terms, or a payment error, and we'll tell you why.
- Lineup doesn't charge creators to use the app.
4. Products
Brands may send you product for their campaigns. What you can request, how often and whether you keep it are set by the brand's program terms. Brands ship product from their own stores and are responsible for it.
5. Acceptable use
Don't use Lineup to:
- Break the law or anyone's rights, including copyright, trademark, privacy and publicity rights.
- Upload content that is sexually explicit, hateful, harassing, violent, misleading or that shows minors in an unsafe way.
- Inflate views or engagement, buy followers, submit someone else's work or delete posts before the required live period ends to game earnings.
- Access accounts or data that aren't yours, get around security or brand separation, or scrape, reverse engineer or overload Lineup.
- Spam or harass brand teams or other creators.
6. Other services
Lineup works with services we don't control, including TikTok, Instagram, Stripe, Shopify and Apple. Their own terms apply when you use them, and we aren't responsible for them. Connecting a TikTok or Instagram account is optional and you can disconnect it at any time.
7. Ending your account
- You can delete your account at any time in the app (Settings, then Delete account) or as described on Delete your account. Earnings you're already owed are still paid to your payout account.
- A brand may end your participation in its program under its program terms.
- We may suspend or close your account if you break these terms, if the law requires it or to protect Lineup, brands or other creators. Where we reasonably can, we'll tell you why and give you a chance to respond.
- Sections 2 (for content already licensed), 3 (for amounts owed), 8, 9 and 10 continue after your account ends.
8. Disclaimers
Lineup is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that Lineup will always be available or error free, or that any brand will offer you campaigns, approve your work or pay a particular amount.
9. Limitation of liability
To the extent the law allows, Ditch.la LLC and its members, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of Lineup. Our total liability for any claim about Lineup is limited to the greater of US $100 or the amount you paid us for Lineup in the 12 months before the claim. This doesn't limit earnings a brand owes you under its program terms. Some places don't allow these limits, so they may not apply to you.
You agree to indemnify Ditch.la LLC against claims by third parties arising from your content or your breach of these terms.
10. General
- Governing law. These terms are governed by the laws of the United States and of the state in which Ditch.la LLC is organized, without regard to conflict-of-law rules, and disputes will be resolved in the courts located there, unless the law where you live requires otherwise.
- Changes. We may update these terms. We'll change the effective date above and, for important changes, let you know in the app or by email. If you keep using Lineup after the change, the new terms apply.
- Apple. These terms are between you and Ditch.la LLC, not Apple. Apple isn't responsible for Lineup or its support, and Apple and its subsidiaries may enforce these terms as third-party beneficiaries.
- Entire agreement. These terms, our Privacy Policy and the program terms of the brands you work with are the whole agreement about Lineup. If a part is unenforceable, the rest still applies. If we don't enforce a term right away, we can still enforce it later.
- Contact. support@lineupugc.com
